Cloud-based issue tracking system
To subscribe to the Plainticket issue tracking service (hereafter the Service), you must have a customer account with Turbine interactive (hereafter TI). The Service is on a web-based platform available through any Internet browser.
The Service is provided on a monthly basis.
We have decided to follow Google policy on browser support, and invest our time in making outstanding services for modern browsers. Thus, we support all major browsers in their last two (2) revisions.
This means we support current versions of Firefox, Chrome, Explorer and Safari. We also support the previous version of all these browsers, but not the versions before.
You sign up by purchasing a subscription using the Accept button of the contract.
The 30-day free trial can be used only one member of an organisation.
Your payment is processed through PsiGate, division of Home Capital Group Inc. You understand that the payment part of the transaction is a contract between you and PsiGate mandating PsiGate to process a payment from your credit card to TI.
You are responsible for maintaining the privacy and security of your subscription information, including, but not limited to, your username and password.
You understand that in the process of using the Service, data are transferred unencrypted over the Internet. You understand that to transfer encrypted-data over the Internet, you must use an SSL encryption protocol. If you do so, you understand that the responsibility of the security of the data transferred in the course of using the Service falls to the third-party responsible for providing the SSL protocol.
Your use of the Service is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied. For example, we make no warranties that the Service will be available at all times, uninterrupted, bug-free and error-free, and regarding the accuracy of the mathematical calculations performed by the Service.
You assume total responsibility and risk for your use of this Service.
We are neither responsible nor liable for any damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service. The responsibility, if any, is limited to the current monthly fee to be reimbursed in proportion to the remaining number of days of Service.
Not excluding any other reason for cancellation of the Service, you may not use the Service to store, host or send unsolicited email, spam or SMS messages, and you may not use the Service to perform any illegal activities, according to either the laws of the country of the end-user or the laws of Canada.
We or our developers own the full intellectual property rights to Plainticket, Groom and ProjMan.
If any provision of the terms of service is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby.
The terms of service set forth the entire understanding regarding the Service between you, the purchaser, and TI, and supersede any prior contract (including, but not limited to, prior versions of the terms of service).
The service terms, including the privacy policy, constitute a fully independent contract as written herein.
This contract is a commercial contract. This contract is not a consumer contract.
This contract is deemed signed in Montréal, Québec, Canada.
This contract is governed by the laws of the Province of Québec, Canada.
